Corrupt brings us a ZDNet column by Jeremy Allison, who says Linux could benefit from more "tough love" in order to improve its functionality and popularity. Excerpting: "As Elie Wiesel said, 'the opposite of love is not hate, it is indifference.' LinuxHater really doesn't hate Linux, despite the name. No one takes that much time to point out flaws in a product that they completely loathe and despise. The complaints are really cries of frustration with a system that just doesn't quite do what is desired (albeit well disguised). A friend pointed out to me that the best way to parse LinuxHaters blog is to treat it as a series of bug reports. A perl script could probably parse out the useful information from them and log them as technical bug reports to the projects LinuxHater is writing about. Deep down, I believe LinuxHater really loves Linux, and wants it to succeed."

An anonymous reader writes "The Washington Post reports, 'The Air Force's top leadership sought for three years to spend counterterrorism funds on "comfort capsules" to be installed on military planes that ferry senior officers and civilian leaders around the world ... Air Force documents spell out how each of the capsules is to be "aesthetically pleasing and furnished to reflect the rank of the senior leaders using the capsule," with beds, a couch, a table, a 37-inch flat-screen monitor with stereo speakers, and a full-length mirror.' Congress told the USAF twice that they could not spend the money on this frivolous project, but they did it anyway."

If you're like me, your favorite part of the bar is the layer of cigarette stench that coats the walls, seats, air and eventually your clothing. It seems the Dutch agree. Rain Showtechniek, a Dutch company that specializes in stage effects, has created a machine that reproduces that wonderful bar smell we all love. "There is a need for a scent to mask the sweat and other unpleasant smells like stale beer. People find that smells such as Mocha coffee, Havana cigars or cigarettes can be about good moods and different ideas of living well" said Erwin van den Bergh, a spokesman for the company. The machines come in various sizes and prices, ranging from the giant £3500 model for exhibition halls to the smaller cafés machines, priced at £440.

Although I'm not sure the corporate overlords will let me retroactively expense a movie ticket, I wanted to take a few minutes to write my review of Hellboy II. It's been a pretty good summer for movies already: but Wall-E and Iron Man were pretty much perfect A movies. I was a big fan of the original Hellboy comic, the first movie, and of Pan's Labyrinth- my fear was that it could only go downhill. And I was wrong. VERY wrong. Read on for my review which will be mostly spoiler free.

utkalum writes "After Steven Warshak's indictment and conviction on charges of mail and wire fraud, money laundering and other federal charges, he learned that key evidence in the case was obtained by the government under a 1986 law permitting no-warrant searches of email communications stored for longer than 180 days. He also learned that, despite the Electronic Communication Privacy Act's requirement that such searches be disclosed to the suspect no more than 90 days after they were commenced, the Government simply couldn't be bothered to comply. Now, the US Court of Appeals for the Sixth Circuit has refused (9-5) to hear Warshak's constitutional challenge to the Act (PDF), claiming that the question raised is 'not yet ripe' for adjudication. It's worth noting that the court also vacated an earlier injunction against using that act to read the e-mail of other people in Warshak's district. Read on for an excerpt from the ruling.

Reader Chemisor advances a theory in his journal that a linguistic misunderstanding is at the root of many disagreements over different licensing philosophies, in particular BSD vs. GPL. The argument is that GPL adherents desire the freedom of their code, while those on the BSD side want freedom for their projects. "It is difficult to spend a week on Slashdot without colliding with a GPL advocate. Eager to spread their philosophy, they proselytize to anyone willing to listen, and to many who are not. When they collide with a BSD advocate, such as myself, a heated flamewar usually erupts with each side repeating the same arguments over and over, failing to understand how the other party can be so stupid as to not see the points that appear so obvious and right. These disagreements, as I wish to show in this article, are as much linguistic as they are philosophical, and while the latter side can not be reconciled, the former certainly can, hopefully resulting in a more civil and logical discourse over the matter." TV Barn writes "We've been conditioned to think that if you pull something off the web and use it, you're committing some sort of copyright infringement. But increasingly, the law is moving in the opposite direction. Provided you are making a truly new use of the content, you are free to make money off those copyrighted images and video and sound. On Monday the Center for Social Media released 'Code of Best Practices for Fair Use in Online Video,' which reflects the latest changes in copyright law that has expanded the understanding of fair use to include 'transformational effect.' Already Miro has endorsed the guidelines, as have several public broadcasters. The Center has a good track record, having issued guidelines for documentary filmmakers that have greatly reduced copyright claims in that area. The website has plenty of resources for mashers and mixers; I interviewed the Center's director in this podcast that summarizes the most important findings of the report."
