According to the CircleID post by Richard Bennett, he 'will not seek a fine against Comcast. Rather, he will simply impose some reporting requirements on them and order them to do what they've already started to do, phase out the current traffic management system in favor of an application-agnostic one. This is second story in a row where the AP have got the facts backwards. Hence, both sides may now officially claim victory.'"

Several readers sent in word that the FCC chairman, Kevin Martin, is calling for sanctions and enforcement actions against Comcast for resetting BitTorrent traffic. "Mr. Martin will circulate an order recommending enforcement action against the company on Friday among his fellow commissioners, who will vote on the measure at an open meeting on Aug. 1... Martin, a Republican, will likely get support from the two Democrats on the commission, who are both proponents of the network neutrality concept. Those three votes would be enough for a majority on the five-member commission."

2muchcoffeeman writes "Former Linspire president and CEO Kevin Carmony — whose relationship with his former employer has turned acrimonious, to say the least — reported on his blog that Xandros and Linspire signed an agreement in principle for Xandros to buy Linspire June 19. Carmony includes a scan of the memo to Linspire shareholders announcing the deal, which requires the former Linspire company to change its name. According to the memo, the stockholders voted to change the company's name to Digital Cornerstone, Inc. Despite the wording of the Linspire memo to stockholders, this deal apparently came as a surprise to Carmony and other stockholders. Some here may remember that both Xandros and Linspire signed patent protection deals with Microsoft in 2007."

Aidtopia writes "FCC Chairman Kevin Martin is proposing auctioning off an unused part of the 25 MHz spectrum on the condition that the winner provide free wireless Internet access. The proposal sets coverage targets that ramp up to 95% of the population within 10 years. The catch: the provider must filter out obscene content." I wonder what definition of "obscene" the FCC would like to use.

bob charlton from 66 tips us to a ComputerWorld story about FCC Chairman Kevin Martin, who has testified that Comcast's P2P traffic management occurred even when network congestion wasn't an issue, contrary to the ISP's claims. After defending its actions and being investigated by the FCC over the past few months, Comcast has tried to repair its image by making nice with BitTorrent and working towards a P2P Bill of Rights. Quoting: "'It does not appear that this technique was used only to occasionally delay traffic at particular nodes suffering from network congestion at that time,' Martin told the Senate Commerce, Science and Transportation Committee. 'Based on testimony we've received thus far, this equipment was typically deployed over a wider geographic area or system, and is not even capable of knowing when an individual ... segment of the network is congested.'

The New York Times is reporting that a plan has been approved by Federal regulators to use text messaging to distribute emergency alerts. The system is scheduled to go online by 2010, and will include three different types of alerts: national alerts (such as terrorist attacks), imminent threats (such as natural disasters), and Amber alerts. From the Times: "The plan stems from the Warning Alert and Response Network Act, a 2006 federal law that requires upgrades to the emergency alert system. The act requires the Federal Communications Commission to develop ways to alert the public about emergencies. 'The ability to deliver accurate and timely warnings and alerts through cellphones and other mobile services is an important next step in our efforts to help ensure that the American public has the information they need to take action to protect themselves and their families prior to, and during, disasters and other emergencies,' the commission chairman, Kevin J. Martin, said after the plan was approved."

Fletch writes "FCC Chairman Kevin Martin could be in for an uncomfortable spring, as House Energy Committee Chair John Dingel (D-MI) has requested a truckload of FCC paperwork relating to some controversial decisions Martin has made. Those include the FCC's reversal on the a la carte cable issue and newspaper-television cross-ownership restrictions. 'This request has got to be turning the FCC completely upside down. Significantly, it appears to reflect a bipartisan discontent with Martin's performance. Democrats and some Republicans are upset over his recent move to relax one of the agency's key media ownership rules, as well as the rushed manner in which he handled the matter late last year. Other Republicans dislike what they see as Martin's persecution of the cable industry, especially Comcast.' The Committee originally announced its intention to investigate the FCC in January."
